1. Agreement

These Terms of Service govern your use of the Gutela website and any order you place through it. By browsing the store or completing a purchase you accept these terms. If you do not accept them, please do not use the store.

2. Store conditions

You must be at least 18 years old to place an order. This store is not intended for use by anyone under 18. You agree not to use the store for any unlawful purpose, and not to breach any law in your jurisdiction through your use of it. We may refuse service or cancel an order at our discretion.

3. Accuracy of content

We work to keep product descriptions, images, prices and availability accurate and current, but we do not warrant that everything on the store is error-free or complete. Where information is out of date, we are under no obligation to update it except where the law requires. Content on this store is provided for general information and should not be relied upon as the sole basis for a decision.

4. Product information

Product images are intended to represent the item accurately, but colours can render differently between screens and small variations in dimensions or finish may occur. Where a variation would materially change what you receive, it is stated on the product page.

5. Pricing and availability

Prices are shown in USD and do not include sales tax, which is calculated at checkout. Prices and availability may change without notice. We reserve the right to limit quantities, to refuse an order, and to cancel and refund an order where an item was listed at an incorrect price.

6. Orders and payment

Your order is an offer to buy. It is accepted when we send you an order confirmation. Payment is taken at the point of order. Full details are set out in our Payment Policy.

8. Returns and refunds

Your data is handled in accordance with our Privacy Policy and our Cookie Policy, both of which form part of these terms.

10. Third-party tools and links

The store uses third-party services for payment, delivery, order tracking and analytics. We provide access to these on an 'as is' basis and are not responsible for their content, accuracy or availability. Any use of a third-party service is at your own risk and subject to that provider's own terms.

11. User contributions

If you send us comments, suggestions or other material, you agree we may use, reproduce and act on it without restriction or obligation to you. We may remove any material we consider unlawful, offensive or otherwise objectionable. You agree that your submissions will not violate the rights of any third party.

Occasionally information on the store may contain typographical errors or inaccuracies relating to descriptions, pricing, shipping times or availability. We reserve the right to correct any error and to change or update information at any time without prior notice, including after an order has been submitted.

To the maximum extent permitted by law, Gutela is not liable for indirect, incidental, punitive or consequential damages arising from your use of the store or from any product purchased through it. Where liability cannot be excluded, it is limited to the amount you paid for the product concerned. Nothing in these terms limits your statutory consumer rights.

15. Indemnification

You agree to indemnify and hold harmless Gutela and its officers, employees and suppliers from any claim or demand, including reasonable legal fees, arising out of your breach of these terms or your violation of any law or the rights of a third party.

16. Severability

If any provision of these terms is found to be unlawful or unenforceable, that provision is severed and the remaining provisions continue in full force.

17. Termination

These terms remain in effect unless terminated by you or by us. You may terminate by ceasing to use the store. We may terminate at any time if we believe you have breached these terms, and you remain liable for any amount owed up to that date.

18. Changes to these terms

We may update these terms at any time. The current version is always posted on this page with the date it took effect. Continued use of the store after a change constitutes acceptance of the revised terms.

19. Governing law

These terms are governed by and construed in accordance with the laws of Pennsylvania, United States, without regard to its conflict of law provisions.
